• Photographs must not contain obscene content nor show any person engaging in illegal activity.
• Please be sure that your photograph does not contain any visible logos, drawing, cartoons, photographs, pictures, phrases or trademarks (other than those of Orville Redenbacher's or ConAgra Foods) or other third party materials.

Grant of Rights.
By submitting my video, photograph or any other material (each a "Submission"), I hereby grant to ConAgra Foods, Inc. and its subsidiaries and affiliated companies and each of their respective licensees, successors and assigns (collectively, "ConAgra"), the unlimited right and permission to use the Submission or any part thereof, including, without limitation, my name, throughout the universe, in perpetuity, in any manner or venue and for any purpose whatsoever, including, without limitation, for purposes of advertising, promotion or trade in promotion and publicizing ConAgra and its products and devices, by means of any and all media and devices whether now known or hereafter devised, which includes, without limitation, the unlimited right and permission to post the Submission on the www.orville.com website (the Website). ConAgra shall have the right, in its sole discretion, to edit, composite, morph, scan, duplicate, or alter the Submission in any manner for any purpose which ConAgra deems necessary or desirable, and I irrevocably waive any and all so-called moral rights I may have in the Submission and I agree that I shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based upon invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, editing, morphing, distortion, illusionary effect, faulty reproduction, fictionalization, or use in any composite form of my name, picture, likeness, voice, and biographical information.

Representations and Warranties/Indemnification.
I represent and warrant to ConAgra as follows: (a) I am the only person who appears or whose voice is heard in the Submission I am submitting (or I am not the only person who appears or whose voice is heard in the Submission, I have secured all rights from all other persons appearing in the Submission necessary to allow me to grant to ConAgra the right to post the Submission on the Website or elsewhere); (b) the Submission is previously unpublished, and previously unproduced work and is original to me (or, if I am not the person that filmed my Submission, the person that filmed or videotaped my Submission has granted to me all rights necessary to allow me to grant to ConAgra the right to use the Submission on the Website or elsewhere); (c) the contents of the Submission are wholly original with me (or, if I have included any third-party materials (including music) in my Submission, I have secured all rights in the third-party materials necessary to allow me to grant to ConAgra the right to use the Submission on the Website or elsewhere, and are not the subject of any actual or threatened litigation or claim); (d) neither the Submission, nor the use of the Submission by ConAgra on the Website or elsewhere will infringe upon or violate the intellectual property rights of other rights of any other person or entity or any applicable laws. I hereby agree to indemnify ConAgra and hold ConAgra harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of my warranties, representations or agreements hereunder.

No obligation to use.
ConAgra shall have no obligation to use the Submission and ConAgra may at any time abandon the use of the Submission for any reason.

By submitting my Submission, I agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with the Submission shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, including cost associated with submitting the Submission, but in no event will attorneys fees be awarded or recoverable; and (3) under no circumstances will I be permitted to obtain any award for, and I hereby knowingly and expressly waive all rights to seek, punitive, incidental or consequential damages and/or any other damages, other than actual out of pocket expenses, and/or any and all rights to have damages multiplied or otherwise increased. I acknowledge and agree that ConAgra is not responsible for any costs, injuries, losses, or damages of any kind arising from or in connection with: (i) transmission, or technical problems, failures, or malfunctions of any kind, whether originating with sender, with ConAgra or otherwise, that may limit my ability to upload my Submission; and/or (ii) any injury or damage resulting from making the Submission (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, or any claims, costs, injuries, losses, or damages related to or based on my rights of publicity or privacy, or a claim that I have somehow been defamed or portrayed in a false light). ConAgra assumes no responsibility for any damage to my computer system which is occasioned by accessing the Website, of for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature, or for the incorrect or inaccurate capture of information, or the failure to capture any information.
